My name is Julius Omar Robinson #26190-177 and I have been on Federal Death Row since 2002 for capital murder crimes I was never charged with, or indicted for, by a grand jury.  Every day I hear from Government officials and the news media how important our Constitution is and how we must protect it. But they must have forgotten about the Constitution when it comes to me and the men like me on federal death row, including Dustin Higgs, Len Davis, and Billie Allen, who had our Fifth Amendment Grand Jury rights denied.  Now the government is trying to kill us.

 

From our nation's beginning, the Grand Jury has played a critical role in our criminal  justice systems, as a shield, standing between the accuser and the accused, protecting the individual citizen against oppressive and unfounded government prosecution.

 

The Grand Jury role as a "shield" is particularly important in death-penalty cases which not only expose defendant’s to the ultimate penalty, but also tend to arouse strong public fervor.  It is likely for those reasons that the Grand Jury Clause of the Fifth Amendment specifically states that "no person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury"

 

I was indicted by a grand jury for many drug crimes and for murder.  But I was not indicted by the grand jury for Capital Murder.  During my appeal, the government conceded the indictment was constitutionally deficient because it failed to allege the statutory aggravating factors that made me eligible for the death penalty.  The Courts agreed that I was denied my constitutional right to indictment by a grand jury, but they decided that the errors were harmless. So here I sit, waiting to be executed.

 

How could trying someone for their life ever be harmless? 

 

I am one of the many young African American males here on death row that is fighting for my life. Since 2010, I accepted Yeshua (Jesus) as my LORD & SAVIOR  and my life has changed. My family and friends enjoy speaking with me over the phone and through Facebook. I believe I have something to give back to my community with my testament of my life and work here on Death Row.
